The Patna Patna High Court on Thursday rejected the Bihar government’s decision to extend the border. The state government has decided to increase SC-ST, OBC and EBC quota from 50 to 65% in educational institutions and government jobs. This was objected to in the High Court.
A bench headed by Chief Justice KV Chandran in the Patna High Court reserved full judgment on Gaurav Kumar and others on March 1.
Now know why the High Court annulled the decision
The questioner had argued that reservation in category should be based on previous article in social and education instead of population. Bihar Government’s decision is violative of Article 16(1) and Article 15(1).
Article 16(1) To provide equal opportunity to all citizens in matters relating to appointment to any office under the State. Article 15(1) prohibits discrimination of any kind.
The match was 75 against the opposition
After the Caste Enumeration survey report was made public, the government had 65 percent support for OBCs, EBCs, Dalits and Adivasis. Economically, the upper caste’s quota has increased to 75 percent from a 10 percent share in Bihar government jobs and higher educational institutions.
